Please carefully read the following Terms and Conditions of use for this website, Directchoicecomfort.com, before using this site. In addition to the Terms and Conditions contained herein, please review the Shipping Policy, Warranty Policy and Returns Policy. By accessing and / or placing an order with this site, users agree to and are subject to the following Terms and Conditions as well as the terms of the aforementioned policies and all applicable Federal, State and Local Laws, Regulations and Codes.
HVAC equipment is designed for installation by qualified, licensed HVAC technicians and is generally regulated by multiple sets of laws, codes and guidelines at Federal, State and Local levels. The manufacturers of the HVAC equipment sold through Directchoicecomfort.com do not approve or endorse any sales of its products direct to consumer without an in-person site inspection and installation by a qualified HVAC professional. Comfort Depot endorses this policy.
The installation of HVAC systems includes electrical, gas and refrigerant connections. Failure to properly install the equipment can result in personal injury, damage to equipment, equipment performance issues and environmental issues. EPA regulations prohibit the opening of refrigerant lines by anyone other than a properly licensed HVAC technician. By purchasing HVAC equipment through Directchoicecomfort.com, the consumer assumes full responsibility for installation and maintenance of the purchased equipment in accordance with Federal, State and Local laws and regulations. A trained professional should always review the unique requirements of your structure to ensure proper equipment selection and safe, efficient installation. Prior to purchasing HVAC equipment, a local HVAC contractor should visit your home or intended location in person to evaluate your structure, assess your current HVAC system, and specify their professional recommendation for appropriate equipment options and optimal size of equipment for the location before you decide on which system to purchase. By making an equipment purchase through Directchoicecomfort.com, you, the purchaser, understands that it is your responsibility to have a licensed HVAC contractor assess, recommend, and install the HVAC equipment. Comfort Depot assumes no responsibility with regard to system or component choice or installation.
Purchaser acknowledges and understands that only an EPA certified contractor can handle refrigerant and charge the AC equipment. We strongly encourage that you have your equipment installed by a local licensed contractor. All work needs to be done to local and state building codes. Comfort Depot accepts no liability for equipment after and during the installation process.
Please note that not all products are exactly as pictured. Please go by model numbers, not pictures as we do not have control of manufacturers' changes.
Comfort Depot shall not be held liable for any failures or delay caused by strikes, differences with workers, or any causes beyond the control of Comfort Depot, including, but not limited to shortages of labor, energy, raw materials, production or transportation, environmental or circumstances deemed acts of God. Comfort Depot shall not be obligated to seek or obtain any settlement which is not in the seller's best interest.
At Directchoicecomfort.com we sell only new products from well established, nationally known brands, with a nationwide network of parts distribution centers. These manufacturers include, with their products, warranty and service information detailing the terms and conditions. Up-to-date warranty information can be obtained through the manufacturers' websites. Warranties on HVAC parts and equipment must be registered with the manufacturer by a licensed HVAC contractor. If installation is not completed and registered by a licensed contractor, the warranty is rendered null and void. Comfort Depot does not provide any warranty above and beyond the manufacturer's warranty and will back up manufacturer warranty as to parts only. Warranty claims will be processed in accordance with manufacturer warranty terms and conditions. Under no circumstances will Directchoicecomfort.com replace a full system or component. Warranty parts can be obtained through most licensed HVAC contractors for the term of the warranty. If a part fails within 30 days from date of delivery and the failure is found to be due to manufacturer defect, we will cover the shipping cost. After 30 days, the shipping charge is the sole responsibility of the consumer.
Under no circumstance will Comfort Depot provide replacement of R22 or R410 refrigerant that may be missing from the system regardless of whether it was missing at delivery, leaked out, or was a replacement part. Systems requiring R22 refrigerant are shipped without refrigerant. Systems requiring R410 refrigerant may require additional refrigerant. A licensed HVAC technician will be required to charge the equipment. Please read the Warranty Policy for more details.
HVAC contractors usually provide a labor warranty on installations. Manufacturer warranties do not cover labor, therefore, Comfort Depot will not be responsible for, nor provide any compensation for any labor costs with regard to installation, diagnosis, repair or other service relating to the products we sell.
In the event that you are not satisfied, your order may be returned within 30 days providing it's in original, brand new condition and installation has not been attempted. You must contact customer service prior to returning the item(s) to obtain a Return Merchandise Authorization number (RMA). You can contact us at firstname.lastname@example.org. The RMA will be dated and the order must be received by Comfort Depot within 30 days from date of the RMA. No returns will be accepted without an RMA number. Shipping charges are non-refundable and you are responsible for the return shipping charges. A restocking fee will apply. The refund will be credited to the original payment method, less restocking fee. Please read Returns Policy
Cancellations can be made prior to shipping by calling our customer service number Monday through Friday 9:00am to 5:00pm. Requests for cancellation cannot be made by e-mail, voice mail, postal or fax. You must call and speak with a customer service representative - no exceptions. Once an order has shipped, it may not be possible to cancel. We can attempt to contact the carrier but there are no guarantees. In any case, shipping charges will apply, for both shipping the product out to you and for returning it to the warehouse as well as any applicable carrier imposed intercept fees. These shipping charges and fees will be deducted from your refund.
Prices quoted at Directchoicecomfort.com are subject to change without notice. Goods are invoiced for the pricing at the time the order was placed. Comfort Depot does not engage in price matching of any kind.
In the event of an error where a product has been listed at an incorrect price, whether by typographical error, mistaken listing, or supplier error, Comfort Depot reserves the right to refuse or cancel any order placed for any product listed at an incorrect price. In the event, such an order has been charged to the customer's credit card, a credit will be issued to the credit card and the customer will be promptly notified.
Limitation of Liability
Comfort Depot shall not be liable for any damages of any kind, whether consequential or inconsequential, that result from the use of, or the inability to use the products sold through Directchoicecomfort.com. This website, including products and all content, are provided “as is” and we, therefore, make no claims as to the suitability of these products for the purpose in which they may be purchased. Use of this site and product selection is the sole decision of the consumer and therefore the consumer shall take full responsibility for choice and suitability of products. Comfort Depot will not provide any compensation and shall not be held liable for any expenses incurred resulting from the installation, operation, use or inability to use equipment. The consumer is responsible for seeking advice from licensed professionals who can provide on-site inspection and accurately determine the consumer's needs. Any information or advise given to the consumer by Directchoicecomfort.com is done so with the assumption that consumer will seek out a local professional. Because the information gathered by Comfort Depot is obtained by the consumer, it is limited and cannot be validated therefore Comfort Depot shall not be held liable for any advice or suggestions that we may provide.
Use of this site constitutes agreement with all of the Terms and Conditions of this site. In addition, the user agrees to proper conduct while conducting business on this site and dealing with employees of Directchoicecomfort.com. Abusive / Threatening language is strictly prohibited. Harassment of any kind, in any manor including, but not limited to e-mail, post, chat, or phone, is strictly forbidden.
Indemnification and Governing Law
You agree to indemnify and hold Comfort Depot, its officers, directors, agents, affiliates, employees, suppliers, advertisers and vendors harmless from all claims, demands and damages of every kind and nature, known and unknown, including attorney fees, costs, and expenses arising out of or relating to any misrepresentations or violations of these Terms and Conditions or this site or any activity related to your account or use of this site.
